SUBJECT : DEFICIENCY IN SERVICES
This is to bring to your kind notice that I had purchased MICROMAX CANVAS DUET 2 EG111 on 4 september 2015 from Modi Enterpises(2015-2016), Street no.-3, Ashok Vihar Main Railway Road, Gurgaon-122001.For a consideration of Rs6909 vide invoice No- 4335. On 25/06/2016 ,I submitted the mobile at Venus entreprises, sector-16, rohini (micromax service centre) as the said product was suffering from the following defects:-
(i) 4211 CELLULAR ACCESS (CDMA) DROP CALLS
(ii) NO CALL OUT FROM CDMA SIM & NO SIM WORKING IN IT.

On 12/08/2016, Service centre employee SUMIT called me to collect my phone which has been repaired. When I went there, I found it defective. So again a new jobsheet was given to my father.

Again on 09/09/2016 , employee called and handed over same defective product and Again a new jobsheet was given to me.

I have reported the above matter to you several times on support centre provided on micromax website, but despite all my pleadings you have not made good the defect in the product(This is deficiency in services) which is indeed regrettable .On account of your aforesaid dereliction of duty and failure and neglect to rectify the same I have suffered huge losses/ incurred expenses in my business.
For which you are liable to compensate to me.
You are hereby finally called upon to remove the said defects in the mobile or replace the defective mobile with new mobile or return the price / charges paid.
Also, You are liable to pay compensation for financial loss and interest suffered due to your negligence or staff negligence( as they handed over me same defective mobile again and again ) in the sum of Rs25000 with interest @18.% per annum within 7days of the receipt of this notice failing which I shall be constrained to initiate against you for redressal of my aforesaid grievances and recovery of the aforesaid amount such proceedings, both civil and criminal as are warranted by law, besides filing a complaint under the statutory provisions of The Consumer Protection Act, 1986 exclusively at your own risk, cost, responsibility and consequences which please note.
